Description
Two-stage partner visa for applicants outside Australia. The 309 is provisional; if the relationship remains genuine and ongoing, permanent residence (100) may follow.

- Genuine, continuing relationship; usually evidence of financial, social, household and commitment aspects.
- Sponsor approved and meets sponsorship obligations.

- Respond to any requests; later, provide updated evidence for the 100 stage when eligible.
820 / 801
Partner (Onshore)
Partner Visa – Subclass 820 (Temporary) & 801 (Permanent)
Description
Two-stage partner visa for applicants in Australia. The 820 grants temporary residence while the permanent 801 stage is assessed later.
Eligibility
- Married or de facto partner of an Australian citizen, PR or eligible NZ citizen.
- Applicant usually must be in Australia when applying and when the 820 is decided.
- Evidence of a genuine and continuing relationship; sponsor must be approved.
- Health and character requirements; visa status/waivers may be relevant.
Key Steps
- Check onshore eligibility and any schedule/regulation bars or waivers.
- Lodge combined 820/801 with sponsor application; provide strong relationship evidence.
- When invited for 801, submit updated evidence to progress to permanent residence.

Fiancé(e) Pathway
Prospective Marriage Visa – Subclass 300
Description
Temporary visa for a fiancé(e) of an Australian citizen, PR or eligible NZ citizen to travel to Australia to marry within the visa period, with a pathway to Partner visas after marriage.
Eligibility
- Genuine intention to marry your sponsoring partner within the visa validity.
- Both parties free to marry and have met in person as adults.
- Sponsor approved and meets sponsorship obligations.
- Health and character requirements satisfied.
Key Steps
- Gather relationship and intention-to-marry evidence (e.g., NOIM, venue plans, communications).
- Lodge subclass 300 offshore; after grant, enter Australia and marry within the timeframe.
- After marriage, apply for onshore Partner (820/801) to continue to permanent residence.
